AUCTION CONDITIONS
Below you will find our auction terms and conditions. We will be happy to answer any further questions you may have - simply send us an inquiry.

1.) The auction is voluntary and in the name and for the account of VINOSAS - Daniel Sutil.
2.) Participation in an auction requires a customer account on the VINOSAS - Daniel Sutil sales platform. Registration is free and can be completed at any time via the website.
3.) The goods will be auctioned in the condition described. The condition descriptions define the condition at the time of the knockdown. All descriptions of condition are made to the best of our knowledge and belief, but do not constitute guaranteed properties within the meaning of Sections 459 et seq. of the German Civil Code (BGB).
4.) We, as the organizer of the auction, reserve the right to combine, separate or withdraw lots from the catalogue without giving any further reasons.
5.) The auction begins at the specified reserve price. Bids are incremented by EUR 5.00.
6.) All auctions have a start and end time – the end time is shown on the respective item page. The winning bidder is the one who has submitted the highest bid at the end of the time. The time is determined by the auction platform's server time. The auctioneer is not responsible for any connection problems, delays, or other technical issues that may prevent timely bidding.
7.) The auctioneer reserves the right to reject bids without giving reasons or to accept them only with reservations. In the case of rejected bids, the auctioneer reserves the right to award the lot to a losing bidder.
8.) Submission of a bid obligates the bidder to accept the item in the event of a knockdown. Ownership, however, only passes upon payment of the purchase price, and the risk of any damage passes to the successful bidder upon knockdown. If the bidder accepts the item subject to reservation, the bidder is bound to their offer for a period of two weeks from the knockdown. If the bidder does not receive unconditional acceptance within this period, the bid expires.
9.) Bids are submitted exclusively via the online platform. Any bids not submitted via the input function on the auction platform cannot be considered. By submitting a bid, the bidder accepts our auction terms and conditions. Due to their registration, each bidder is personally liable for their purchases and cannot claim to have acted on behalf of third parties. -
10.) After the successful bid, the successful bidder will receive a confirmation email to the email address provided during registration, requesting payment for the auctioned item via our online shop. To do so, the customer logs into their user account and, under the "Auctions" menu item, will find a list of their bids, along with the option to add successfully won items to their shopping cart. From this point on, the purchase will be processed via the regular online shop, subject to the applicable general terms and conditions.
There are no additional costs for the bidder upon successful bidder's acceptance. The successful bidder only has to pay the shipping costs, which are displayed and calculated during the payment process.
Payment is due in full immediately after the knockdown, but no later than five working days after the knockdown. If payment is not made or is not made on time, the auctioneer may, at its option, demand fulfillment of the purchase contract and, independently of this, re-auction the relevant lots at the successful bidder's expense or allocate them to a losing bidder. In this case, the successful bidder is liable for the loss and his rights from the previous knockdown. In the event of a re-auction, the successful bidder is not entitled to any additional proceeds.
In case of late payment, interest will be charged at a rate of 1% for each month or part thereof.
Even without a reminder, the bidder is liable for any damages in the event of late payment or refusal to accept a lot that has been knocked down.
The successful bidder is responsible for receiving automated emails from our auction system and must ensure that these emails are not blocked by any spam filters. Entering an incorrect email address does not release the bidder from their obligations.
11.) The auctioned lots can only be received after full payment has been received. Delivery of the wines will be subject to the shipping conditions applicable in the online shop. Freight charges are borne by the successful bidder.
12.) The place of performance and exclusive jurisdiction is Munich. The legal relationship is deemed to be governed by German law.
13.) The provider assumes no liability for the loss or incorrect transmission of data. The user bears the full risk for any damages and consequential damages of any kind caused by the operation or malfunction of the auction software.
